In June 2026, Community Board 5 was told that DOB had facilitated a brightness reduction for the LED sign at 230 West 54th Street. For three months, no written record of that arrangement could be found. Two Freedom of Information Law requests seeking it came back without it. A written request to DOB’s community board liaison went unanswered.
On September 2, 2026, in response to an administrative appeal, DOB produced the record. It is an email exchange, May 14 to 27, 2026, between the Director of DOB’s Sign/Padlock Unit and an executive of the sign’s advertising operator.
The exchange contains the operator’s own description of the sign’s brightness schedule, and an offer to reduce brightness to 12.5 percent at 8 PM and 7.5 percent at 10 PM. It also contains the Director’s own observations. On the sign at night: ‘There’s not problem in the daytime, but when I saw the sign after 10:00pm it was still very bright.’ On the sign’s unauthorized flashing: ‘That’s just a paperwork issue and you’re going to have an opportunity to address the flashing issue in the job plans.’ On the operator’s response to DOB’s own enforcement letters: ‘No one responded to the intent to revoke letters.’ And to the operator directly: ‘On the nuisance issue can you give me something concrete I can offer the residents?’
What the exchange does not contain is any of the things an enforceable standard requires. There is no signed instrument. There is no illumination standard, no measurement, and no verification. There is no enforcement mechanism, and no party with the power to enforce anything. The Zoning Resolution’s protection for residences near illuminated signs, Section 32-64, contemplates standards set by rule. What the residents of the West 50s received instead was a percentage, offered in an email, by the company that owns the sign.
In 2019, DOB drafted a written response to an Assembly Member’s inquiry about this sign and decided on a phone call instead. In 2026, the written answer to the neighborhood’s oldest question turned out to be an email nobody could enforce. The documents are available on this page, as produced.
